Insurance payments to victims of accidents at work or occupational diseases at a stable disability
Abstract
In Ukraine, all insured people who have suffered from accidents at work or occupational diseases are entitled to
insurance payments. The entire list of insurance payments is defined in the Law of Ukraine “On Compulsory State
Social Insurance”. Usually, the type of insurance payment to which the insured person (members of their family)
has the right depends on the consequences of an accident or occupational disease: temporary disability, permanent
disability, the death of a person.
In case of confirmation of a person’s permanent disability, the person has the right to monthly insurance payments
and one-time assistance. The author emphasizes that the person can expect to receive a monthly payment in the amount
equal to the salary she had until health damage only in case of defining the total loss of professional disability.
The article states that the amount of one-time assistance is determined according to the degree of loss of
professional ability, based on the seventeen amounts of living wages for people able to work.
Having investigated the grounds and procedure for the implementation of monthly insurance payments and
one-time assistance, the author comes to the conclusion that there is a need to introduce a number of amendments
to the Law of Ukraine “On Compulsory State Social Insurance” and the Resolution No. 11 “On Approval of the
Procedure for Appointment, Transfer, and Conduct of Insurance payments”, namely: 1) to determine the cases whew
the previously assigned amount of monthly insurance payment is subject to reduction; 2) to provide the person
with the right to supplement the received one-time assistance in case of deterioration of their health as a result of
previously acquired injury or occupational disease; 3) while determining the exact percentage to be reduced in
the amount of one-time assistance (in the case of confirmation of the wrongful conduct of the victim) to take into
account the criteria proposed by the author; 4) to take into account the fault of the victim not only while determining
the amount of one-time assistance but also in. the implementation of other types of insurance payments.
